Landlord and Tenant Disputes in Iran: Eviction and Deposits

Eviction orders, return of the deposit, unpaid rent, damage and repairs, terminating a lease and goodwill rights in commercial premises

01

Which law applies?

Leases concluded from 1998 onwards are governed by the Landlord and Tenant Law of 1997 and the Civil Code. Commercial leases made before then fall under the 1977 law, under which tenants may hold goodwill rights (haqq-e kasb va pisheh) that restrict eviction.

Under Article 3 of the 1997 law, if the lease is official, or private but in two copies signed by two witnesses, the landlord can obtain a fast eviction order once the term ends—conditional on returning or depositing the tenant’s security deposit. Other leases require an ordinary eviction claim.

02

Deposits, rent and termination

The landlord may deduct proven unpaid rent, bills and damage from the deposit but cannot simply keep it. A signed handover record with photos prevents later disputes. A lease is binding; termination needs a contractual or legal ground such as late rent under a termination clause, unauthorised subletting or change of use, and should be notified formally.

Shahin Group checks the governing law, calculates permissible deductions, files eviction or deposit claims and drafts leases that keep the fastest legal routes open.
